3rd August 2010 - Legislation notes on the Employee Study and Training Regulations.
From April of this year (2010) all UK based organisations employing over 250 people are subject to the Employee Study and Training Regulations. From April 2011 all organisations no matter what their size are subject to these regulations. Under the 'time to train' right, employees can lawfully request:
-
Training leading to a qualification that will help people develop their workplace performance
-
Training that doesn’t lead to a qualification that will help people develop their workplace performance There is no legal time limit for the length of time that the study or training may take. So it is pretty safe to say that someone nearing retirement may be as eligible to request time as sometime who may be with an employer for the foreseeable future. The most important requirement is that the training requested will help improve organisational performance or effectiveness. More information can be found here:

Can we help? Yes, we do not offer legal advice about HR matters and strongly suggest any legal issues are discussed with a suitably competent person with knowledge in this area. However, we can sell you our quality assured ‘Undertaking a Training Needs Analysis’ workbook, which includes up to 2 hours worth of telephone and videoconference support for £500 plus VAT. This will take people unfamiliar with identifying who needs to learn, what they need to learn, by when and how much it will cost you. So if an employee comes to you asking for time – you can use this material to objectively see if time needs to be granted! Call us for more details on +44(0) 1246 267 724.
